Which would make the UN a real world police. And what if the bad guy 
was one of the big guys ?

Not so easy to make your suggestion come true.
Just look at the 'succesful' way Truman or Saddam Hussein were brought 
to trial, not to mention mass murderers and tyrants such as Stalin, Pol 
Pot, Idi Amin or Pinochet.

This would turn the UN into something of a world GESTAPO. Among the 
basic human rights there certainly is the statement that you can't be 
punished for a crime you didn't commit, i.e. if your cousin is the evil 
overlord, you might be punished for helping him, but not just for being
his 
cousin.
