Copyright aside, its 'unlikely' that you will be pursude legally
by a defunct company or by the current mold owner who isn't
doing anything with the molds. 

The same sort of grey area surrounds out of print rules and such, 
if you were to OCR such a rule set, it is 'unlikely' you would be 
pursued legally especially if you keep a low profile and don't try
to profit from it. 

For example the old FASA TCS rules are now available 
as a PDF file. 

Most of us don't think twice about taping a TV show or CD for our 
own use, though the 'law' may say its a copyright infringement and 
no different in its eyes from copying  computer programs, miniature 
or rules.
